Calvert County Probation Violation Lawyer

A violation of probation hearing determines whether probation conditions were broken. Outcomes can include time on suspended sentences, striking a PBJ, or a civil judgment that affects credit and future sentencing exposure.

If you have a violation of probation in Calvert County, talk to an attorney right away.

What's at stake?

If found in violation of probation, the court can impose all or part of your backup time, potentially consecutive to any sentence for a new charge. Not all violations warrant maximum sanctions; the court’s authority depends on whether the violation is "technical" or "non-technical."

Penalties for "Technical Violations"

The JRA sets presumptive caps for technical violations (special-condition breaches that don’t involve a new criminal offense, violating a no-contact order, or absconding): 15 days (first), 30 days (second), 45 days (third). A fourth technical violation can lead to full backup time. Courts can exceed caps with findings but usually follow them.

Penalties for "Non-technical" violations of probation

Non-technical violations include a new conviction while on probation, violating a no-contact order, or absconding (not reporting). These may lead to the full backup time. Even without a new conviction, the State can proceed on a lower standard in VOP.

Minor civil moving violations like a speeding ticket generally do not violate probation.

How does a hearing on a violation of probation work?

VOP hearings are informal, with relaxed evidence rules. The State must prove a violation by a preponderance of the evidence. You may admit or deny, testify, present witnesses, and cross-examine the State’s witnesses—often your probation agent. If the court finds a violation, it receives mitigation before deciding any sanction.
