Maryland Murder Lawyer

Maryland's two degrees of murder

Maryland splits intentional killings into two felonies under Title 2 of the Criminal Law Article:

  • First-degree murder (CR § 2-201): a "deliberate, premeditated, and willful killing," killings by lying in wait or by poison, or killings committed during the perpetration of an enumerated felony (the felony-murder rule). The sentence is imprisonment for life. The State can elect to seek life without the possibility of parole.
  • Second-degree murder (CR § 2-204): "A murder that is not in the first degree under § 2-201" is in the second degree. The maximum sentence is imprisonment not exceeding 40 years.

The line between first and second degree is the State's burden. Without premeditation, deliberation, and willfulness, the case is second-degree at most.

Related homicide charges

The State frequently charges murder in the alternative with these lesser homicide offenses. A defense often runs by negotiating the murder count down to one of these:

  • Voluntary or involuntary manslaughter (CR § 2-207), maximum 10 years
  • Manslaughter by vehicle, grossly negligent (CR § 2-209), maximum 10 years
  • Homicide by motor vehicle while under the influence of alcohol (CR § 2-503), maximum 5 years
  • Attempted first-degree murder (CR § 2-205), maximum life
  • Attempted second-degree murder (CR § 2-206), maximum 30 years

What happens in the first 48 hours

A murder arrest in Maryland follows a predictable timeline. The defense decisions at each step are not.

  1. Arrest and initial appearance. A District Court Commissioner sees the defendant within 24 hours. On a murder charge, the Commissioner will hold without bond. Bond review in front of a judge follows within the next day or two.
  2. Bond review. This is the first time a judge hears the defense side. A prepared lawyer brings family witnesses, employment records, ties to the community, and a written argument addressing the State's flight-risk and dangerousness theory.
  3. Statement of charges. The original document filed at arrest. The case will be transferred to Circuit Court within 30 days.
  4. Indictment. A Circuit Court grand jury returns an indictment. The State now has discovery obligations and a firm trial track.
  5. Arraignment and motions. Suppression motions, severance motions, motions in limine. The defense fight starts here, well before trial.

Defenses in Maryland murder cases

Every murder case has its own facts, but the openings tend to fall into a small set:

  • Identification. Most murder cases are circumstantial identification cases. Eyewitness ID, cell-site location, surveillance video, and DNA each have known weaknesses. A motion to suppress a suggestive showup or a thin photo array can put the State's case on the defensive.
  • Self-defense. Maryland recognizes both perfect and imperfect self-defense. Perfect self-defense is a complete acquittal. Imperfect self-defense reduces murder to voluntary manslaughter.
  • Defense of others. Same framework as self-defense, applied to the protection of a third person.
  • No premeditation or deliberation. This defense does not deny the killing. It denies the State's ability to prove first-degree murder. A successful version brings the conviction down to second-degree, dropping the life sentence in favor of a finite sentence not exceeding 40 years.
  • Suppression of the confession. A statement to a homicide detective made without proper Miranda warnings, or after the suspect invoked the right to counsel, is suppressible. In most murder trials, the State's case rests heavily on the defendant's own words.
  • Cell-site and digital forensics challenges. Cell tower location data has known precision limits. Surveillance video timestamps are often wrong. A defense expert can dismantle the State's timeline.
  • Witness credibility. Cooperating witnesses, jailhouse informants, and witnesses with their own charges are vulnerable on cross-examination.

Prince George's County homicide cases are prosecuted out of the State's Attorney's Office in Upper Marlboro. The PG County PD Homicide Unit handles the investigation. The judges in PG Circuit Court see a high volume of murder cases, and the State's Attorney's homicide team is among the most experienced in the State.

Stakes

A first-degree murder conviction in Maryland is a life sentence. A second-degree murder conviction is up to 40 years. Mandatory minimums under use of a firearm in a crime of violence (CR § 4-204) and wear, carry, or transport handgun (CR § 4-203) stack on top of the homicide sentence when a gun was used.
