Public Defender vs. Private Attorney for a DUI in Maryland

A public defender can provide skilled courtroom representation in a Maryland DUI case. Many public defenders are experienced trial lawyers, including lawyers who later enter private criminal defense practice. The practical difference is usually not commitment or ability. It is the time, access, and scope of representation available before court.

A private DUI attorney can begin working with you immediately after the arrest, request and prepare for the separate MVA hearing, review the police paperwork, and help you complete useful steps before the first court date. A public defender often carries a much larger caseload and may not begin substantial work with a client months before trial. You also should not assume that representation in criminal court includes the separate MVA proceeding.

That timing matters. Maryland gives many drivers a temporary paper license for 45 days after a failed or refused chemical test. You generally have 10 days to request an MVA hearing and keep driving while the hearing is pending, and 30 days to request a hearing at all. A person who waits for the criminal court date can arrive without realizing that the MVA suspension already started because no action was taken during that earlier period.

  1. The criminal court case. This is where the State prosecutes the DUI or DWI charge. Possible issues include the legality of the stop, field sobriety testing, breath or blood evidence, statements, trial, and sentencing.
  2. The MVA license case. This is an administrative process involving the Motor Vehicle Administration and Office of Administrative Hearings. It can suspend your license based on a failed test or refusal even if the criminal case has not been tried.

The court and MVA tracks have different deadlines and decide different questions. Winning one does not automatically win the other. An acquittal or dismissal in court does not reverse a license suspension that already took effect because the driver missed the MVA deadline.

This is one of the biggest practical differences between hiring private counsel immediately and waiting for appointed counsel in the criminal case. A private DUI lawyer can address both tracks from the start. Before relying on a public defender for the license issue, ask directly whether that lawyer will represent you at the MVA hearing.

The 10-Day, 30-Day, and 45-Day Problem

The temporary paper license issued after a test failure or refusal is generally valid for 45 days. That does not mean you have 45 days to decide what to do.

  • Within 10 days: Requesting the hearing during this period can keep the suspension from beginning before the hearing.
  • Within 30 days: This is generally the outside deadline to request the administrative hearing.
  • At 45 days: If no effective action was taken, the temporary license expires and the suspension begins.

The criminal court date may be scheduled after these deadlines. By the time a person meets assigned counsel or appears for trial, the opportunity to request a timely hearing may already be gone.

That creates a harsh surprise. A driver can walk into court focused on avoiding a DUI conviction while unknowingly having driven on a suspended license since day 46. The criminal case did not cause that suspension. Inaction on the separate MVA case did.

How a Private DUI Attorney Can Work Before Court

Hiring private counsel shortly after the arrest gives the lawyer time to work before the first contested hearing. Depending on the case, that preparation can include:

  • Requesting the MVA hearing within the applicable deadline
  • Reviewing the DR-15 and DR-15A paperwork for omissions or errors
  • Deciding whether to contest the suspension or enter ignition interlock
  • Gathering employment, school, childcare, and medical information relevant to driving privileges
  • Reviewing the traffic stop, arrest, and chemical test
  • Requesting and organizing body-camera footage and other discovery
  • Identifying problems with field sobriety testing
  • Discussing alcohol treatment or education when appropriate
  • Preparing the client for court and setting realistic expectations

Early work does not guarantee dismissal, acquittal, or a particular MVA result. It does prevent deadlines from passing unnoticed and gives the lawyer more time to find problems in the State’s evidence.

  • How many DUI cases does the lawyer handle?
  • Does the lawyer review body-camera and testing evidence?
  • Does the lawyer try DUI cases when the evidence supports trial?
  • When will preparation begin?

The fee comparison should account for scope. A lower fee that excludes the MVA hearing is not the same service as representation covering both the license and criminal cases.

Which Option Is Better for Your DUI?

If you qualify for a public defender and cannot afford private counsel, use the representation available to you. Ask early who is assigned, when you can discuss the case, and whether the MVA proceeding is included. Do not wait for the court date to investigate your license status.

Private counsel may be the better fit when:

  • You want the lawyer involved immediately
  • The MVA deadline is still open
  • Keeping your license is essential for work or family
  • You need help deciding between a hearing and ignition interlock
  • You want direct access to the lawyer handling the case
  • The case involves a refusal, high test result, accident, prior DUI, or professional consequences
  • You want the criminal and administrative strategies coordinated

The best lawyer is not determined solely by whether the lawyer is public or private. DUI experience, preparation time, communication, and the scope of representation matter more.
